Tenant at 39 Rangeview Road ends her tenancy in state home
The tenant at 39 Range View Road has informed Housing New Zealand that she no longer wishes to continue her tenancy in Mount Albert, Auckland.
"Housing New Zealand is delighted by this outcome, and welcomes the tenant's decision," Housing New Zealand chief executive Lesley McTurk said.
"This outcome eliminates the need for a third Tenancy Tribunal hearing of Housing New Zealand's case to terminate her tenancy. This saves time and money, and the need for up to 10 local people to appear as witnesses in the case."
Housing New Zealand has been engaged in a two year legal battle over the Rangeview Road tenancy after people associated with it caused significant disruption to the community.
"We sought to end this tenancy because we felt the activities of the household were having a considerable negative impact on the community, and on neighbours. The obligations of the tenant to her neighbours were not being upheld," Dr McTurk said.
"Two years is far too long to get this matter clarified, and has created prolonged uncertainty for the tenant, her family, and for the residents of Rangeview Road. The case has required an appeal to District Court, the judgment of which was precedent setting. It illustrates some of the challenges Housing New Zealand and other landlords face in maintaining an appropriate balance between the rights of tenants and those of neighbours.
"Last year Housing New Zealand began to completely redesign its approach to dealing with cases of anti-social behaviour by a small minority of tenants," Dr McTurk said.
"We intend to introduce a faster process that delivers a definitive outcome for tenants and the community. We recognise that in times of rising need, it is imperative we deal with these types of situations cleanly and quickly to ensure we can house more families on our waiting list.
"The Corporation will announce its new approach over the next few weeks, and we will trial it in Pomare in the Hutt Valley. We cannot provide any further details at this time because to do so may prejudice the outcome of any action we take in Pomare," Dr McTurk said.
"Housing New Zealand will also assist the tenant at 39 Rangeview Road to find alternative accommodation outside of state housing."
